Terms of Service

1. Acceptance of Terms

By accessing or using nocensor.ai, you agree to be bound by these Terms of Service. If you do not agree, do not use the service. You must be at least 18 years old (or the age of majority in your jurisdiction).

2. Service Description

nocensor.ai provides AI-powered image and video generation tools. All content is generated by artificial intelligence models. The service operates on a credit-based system — users purchase credits to generate content.

3. Intellectual Property

AI-generated outputs produced through the service are owned by you, subject to these Terms. You are solely responsible for ensuring your use of generated content complies with applicable law. You grant nocensor.ai a limited, non-exclusive, royalty-free license to retain and process generated outputs and uploaded content solely for the purpose of operating the service, including safety review, abuse detection, and legal compliance obligations. nocensor.ai does not claim ownership of your generated outputs.

The nocensor.ai platform, branding, underlying AI models, and software are owned by nocensor.ai and are protected by applicable intellectual property laws. You may not copy, modify, or distribute them without express written permission.

4. User Responsibilities

  • You must be at least 18 years old to use this service.
  • You are responsible for all content you generate using the service.
  • You must not generate content depicting real minors in any context.
  • You must not use the service to create non-consensual intimate images (NCII) of real, identifiable individuals.
  • You must comply with all applicable laws in your jurisdiction.

5. Face Swap — Consent and Biometric Data

The face swap feature processes facial images using AI. By uploading face images, you represent that you have obtained explicit consent from the individual depicted, or that the image is of yourself. Uploaded face images are processed on GPU infrastructure in the United States and deleted within 48 hours of generation completion. Exception: if a job is flagged during automated safety screening, the image and associated job data may be retained for up to 1 year as required by 18 U.S.C. § 2258A (REPORT Act) and the TAKE IT DOWN Act. Retained content is accessible only to authorized personnel and law enforcement.

6. Payments and Refunds

Credits are purchased via cryptocurrency (Bitcoin, other supported coins) or credit card. Credits deducted for generations that fail to complete are automatically returned to your account balance. Credits used for completed generations are non-refundable. Unused credits do not expire.

7. Prohibited Content

  • Child sexual abuse material (CSAM), including AI-generated
  • Non-consensual intimate images of real, identifiable persons
  • Content that violates applicable law

Violations result in immediate account termination and reporting to relevant authorities.

8. NCII Reporting (TAKE IT DOWN Act)

If you believe non-consensual intimate imagery of you has been generated or distributed using our service, you may submit a report to legal@nocensor.ai. We will remove reported content within 48 hours of receiving a valid report, as required by the TAKE IT DOWN Act.

9. Repeat Infringer Policy

We maintain a repeat infringer policy. Users who repeatedly violate these terms or submit invalid DMCA counter-notices will have their accounts permanently terminated.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. nocensor.ai does not warrant that the service will be uninterrupted, error-free, or produce any particular output. We reserve the right to modify or discontinue the service at any time without liability. Your use of the service is at your sole risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, nocensor.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the service. nocensor.ai is not liable for any content generated by users. Our total aggregate liability for any claim arising from use of the service shall not exceed the amount you paid to nocensor.ai in the 90 days preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless nocensor.ai and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the service; (b) content you generate using the service; (c) your violation of these Terms; (d) your violation of any applicable law or third-party rights; or (e) biometric data you upload without authorization from the depicted individual.

13. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Sheridan County, Wyoming.

14. Account Termination

You may request deletion of your account and all associated data by contacting privacy@nocensor.ai. We will process deletion requests within 30 days. We reserve the right to suspend or terminate accounts that violate these Terms, with forfeiture of any remaining credits.

15. Modifications to These Terms

We may update these Terms at any time. Material changes will be communicated by email or in-app notice at least 7 days before taking effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
